Terms and conditions for the sale and purchase of goods from our website www.wildfish.org.uk

These terms and conditions give important information and set out the legal terms and conditions on which we sell products from our website to you.

1. About these terms and conditions

1.1 These terms and conditions (together with our Privacy Policy and Terms and Conditions of Use of our Website) will apply to any contract between us for the sale of products to you. By using this website and/or placing an order for a product you agree to be bound by these terms and conditions. Please read these terms and conditions carefully and make sure you understand them before ordering any products from our website as they affect your rights under the law. When you click on the [“CHECKOUT”] button you are signifying your agreement to these terms and conditions. If you do not agree with these terms and conditions, you must not click on the [“CHECKOUT”] button.

1.2 We may change these terms and conditions from time to time without notice to you, for example, to take account of new ordering or payment processes or new products. Changes will only apply to subsequent orders you make on the website.

1.3 Please check these terms and conditions every time you wish to order a product from our website to ensure you understand the terms which will apply at that time.

2. Ordering our products

2.1 Our website will guide you through the ordering process, please ensure you have checked your order before submitting it. We will contact you to confirm we’ve received your order and accepted it and when we dispatch the product to you.

2.2 We may reject orders, including after we have confirmed we have accepted it, for example because a product is out of stock, because you are located outside the UK or because the product was mispriced by us. When this happens, we let you know as soon as possible and refund any sums you have paid. We reserve the right to cancel any order prior to dispatch at our sole and absolute discretion, whether or not you have already been charged.

2.3 Products can vary slightly from their pictures and a product’s true colour may not exactly match that shown on your device or in our marketing or its packaging may be slightly different. Images of products are for illustrative purposes only and do not give any representations about a product or its current availability.

3. Price and payment

3.1 The price for a product is as listed on our website, save in cases of obvious error. The price includes UK VAT at the applicable local rates but excludes delivery costs which are payable in addition and which will be added to the total amount due.

3.2 We reserve the right to change the prices of our products at any time, but changes will not affect orders in respect of which we have already accepted, save as provided in clause 2.2.

3.3 By using a credit/debit card to pay for your order, you confirm that the card being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

4. Delivery

4.1 We will send the products ordered by you by Royal Mail or other delivery provider to the address you give us for delivery at the time you make your order. The products will be dispatched as soon as reasonably possible after your order is accepted and in any event within 7 days of your order, subject to the application of clause 2.  You will become the owner of the products and risk will pass to you upon delivery.

4.2 If our supply of your product is delayed by an event outside our control we will contact you as soon as possible to let you know whereupon you can contact our Customer Service Team by emailing info@wildfish.org or by telephoning 07496 358 016 to cancel your order if you wish to do so.

5. Returns and refunds

5.1 For most of our products bought online you have a legal right under consumer protection legislation to change your mind about your purchase and receive a refund of what you paid for it, including standard delivery costs. We don’t refund any special charges you may have paid for express delivery or delivery at a particular time.

5.2 You can’t change your mind about an order for:

5.2.1 products sealed for health protection or hygiene purposes, once these have been unsealed after you receive them;

5.2.2 goods that are made to your specifications or are clearly personalised; and/or

5.2.3 goods which become mixed inseparably with other items after their delivery.

5.3 If you change your mind about a product you must let us know no later than 14 days after the day it is delivered. If your purchase is split into several deliveries over different days, the period runs from the day after the last delivery.

5.4 To let us know you want to change your mind, contact our Customer Service Team by emailing info@wildfish.org or by telephoning 07496 358 016.

5.5 You have to return your product to us within 14 days of your telling us you have changed your mind. Returns are at your own cost. You can send the product back to us, using an established delivery service. If you do this you should keep a receipt or other evidence from the delivery service that proves you have sent it and when you sent it. If you don’t do this and we don’t receive the goods we won’t refund you the price.

5.6 If you handle the product in a way which would not be acceptable ‘in-store’, we may reduce your refund, to compensate us for its reduced value. For example, we may reduce your refund if the product’s condition is not “as new”, price tags have been removed, the packaging is damaged or accessories are missing. In some cases, because of the way you have treated the product, no refund may be due.

5.7 If you tell us you’ve changed your mind about a product that hasn’t yet been dispatched, we refund you as soon as possible and within 14 days. If you’re sending your product back to us, we refund you within 14 days of receiving it. We refund you by the method you used for payment. We don’t charge a fee for the refund.

5.8 If you think there is something wrong with your product, you must contact our Customer Service Team by emailing info@wildfish.org or by telephoning 07496 358 016. We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law. You may return a faulty item to us for a refund within 30 days of delivery of the product.

6. Use of personal information

All personal information that we may collect (including, but not limited to, your name, address, email address, recipient details and telephone number) will be collected, used and held in accordance with the provisions of applicable data protection legislation and in accordance with our Privacy Policy [https://wildfish.org/privacy-policy/].

7. Further terms

7.1 The contract is between us and you. No other person shall have any rights to enforce any of its terms.

7.2 We may transfer our rights and obligations under a contract to another organisation but this will not affect your rights or our obligations under these terms and conditions. You may only transfer your rights or your obligations under these terms and conditions to another person if we agree in writing.

7.3 No failure or delay by us in exercising any of our rights under these terms and conditions means that we have waived that right, and no waiver by us of a breach of any provision of these terms and conditions means that we will waive any subsequent or later breach of the same or breach or default of any other provision.

7.4 These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales which means a contract for the purchase of products through the website and any dispute or claim arising out of or in connection with it, the products or any matters arising therefrom or associated therewith shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.

7.5 If any of these terms and conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
